This privacy policy (“Privacy Policy”) covers the data collection and processing activities of Walker Edison Furniture Company LLC and all its wholly-owned subsidiaries (hereinafter referred to as “Walker Edison”). At Walker Edison we take the privacy of our customers very seriously.

Since 2006, Walker Edison has looked at eCommerce differently than our competition by providing a platform that specializes in solutions for major online retailers. Specializing in product development and merchandising, we have a team of in-house specialists who put in the necessary work to provide our sales partners (“Partners”) with the right products to meet their growing needs.

Walker Edison designs and brings to market the highest quality RTA furniture possible. Walker Edison is not in the business of monetizing the personally identifiable data (“PII”) (as defined by applicable law) of its customers.

DATA COLLECTED

Fulfilling customer orders and operating our business, including customer or warranty services, necessarily requires Walker Edison to receive at least some PII associated with an order. Specifically, Walker Edison may receive a full name, shipping address, contact information, and purchase details for each order you place with us or one of our Partners. Where applicable, we or entities we work with may also receive an email, website account login information, and/or payment information from you. We may also collect any PII you choose to provide us with for applicable communications regarding your order, marketing updates you sign up for, etc.

 

Walker Edison, or third parties it works with, may also collect or use additional PII such as your name or contact information (including phone number, email address, or mailing address), IP address, browser type, information about your operating system, internet browsing data, whether you read emails we send you, and your general location. This PII helps us understand how you use our website and other offerings and gives us the feedback we need to improve them. It may also be used to enhance our ability to serve you and for analytics or marketing. For additional information, you may see the “Cookies” section below.

 

We periodically review our data retention policy to confirm that PII we collect is only retained for as long as is reasonably necessary to fulfill the purposes for which it is collected, including the fulfillment of purchases, customer services, warranty services, and/or our own internal statistics and functions.

DATA SHARING

Some PII we collect will be shared with and/or stored by third-party providers who are contracted to provide services necessary for Walker Edison to operate and/or fulfill and service customer orders and requests. As an example, we may provide some of your PII to a third-party shipping service in order to have your item shipped to you. We may also share PII with third parties for other reasons, such as:

 

  • To better facilitate and improve our business functions, including the operation and security of our website, customer services, and/or data management and storage;
  • For assistance with marketing purposes, communications, and/or product reviews;
  • When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, comply with applicable laws, investigate fraud, or respond to government request(s), and such disclosure is not otherwise prohibited by law;
  • To any other third party with your prior consent to do so;
  • If Walker Edison is involved in a merger, acquisition, or sale of all or a portion of its assets, which change you will be notified of as necessary under applicable law(s); or
  • As otherwise required by law.

 

Some of this sharing may be facilitated by cookies, which are discussed in more detail below. Walker Edison does not sell PII to third parties for monetary consideration. However, there may be situations in which you have the right to opt out of certain sharing of your PII. For more information see the “Opt-Out” section below.

 

COOKIES

When you visit our website or open applicable communications with us, Walker Edison may send cookies to your device or leverage various similar technologies including website applications (hereinafter collectively “cookies”) to serve you. Certain of our providers, or third parties we or they work with, may also use cookies to collect information in connection with us or on our behalf.

 

While the exact cookies can change from time to time, the applicable categories of cookies we or those we work in connection with (collectively “we” or “us” for the purpose of this list) may use include cookies that:

Walker Edison’s website is hosted by Shopify, and Shopify may choose to use its own cookies to collect data. Walker Edison is not responsible for these cookies, but they may be viewed at https://www.shopify.com/legal/cookies. Shopify may also use automated decision-making to conduct risk and fraud screening.

 

OPT-OUT
Walker Edison does not sell its customers’ PII for money. However, applicable law(s) may define the “sale” of PII more broadly than as an exchange for money. DO NOT TRACK
Some web browsers incorporate a “Do Not Track” or similar feature (such as Global Privacy Control signals, see https://globalprivacycontrol.org/) that signal to websites that you visit that you do not want to have your online activity tracked. Our Site recognizes Global Privacy Control signals for California residents.
 
SENSITIVE PII

What is considered “sensitive” PII depends on applicable law(s) but may include account log-ins and passwords, health data, your precise geolocation, or identification such as your driver’s license or social security number. Walker Edison or third parties we work with may collect sensitive PII such as account log-in information and passwords to provide our goods/services. We will only collect and use sensitive PII with your permission. We do not disclose or collect your sensitive PII for any other purposes, nor do we collect or process it with the purpose of inferring characteristics about you or other consumers.

 

DATA SECURITY
Walker Edison receives PII from you directly or from our Partners through secured data transfers. In most cases, Partners transmit PII into our order fulfillment software using an electronic data interface (EDI) that eliminates the need for human mediation. This allows safe data transfers and reduces the risk of unauthorized access by third parties.


In cases where EDI is not used, Walker Edison employs strict IT policies to ensure only authorized users obtain and process the PII. Where possible, PII received outside of an EDI process is entered into a secured database and the original PII is permanently deleted from all other IT systems.


Regardless of how Walker Edison receives PII, all PII is encrypted while at rest within our customer and order management systems. Additionally, all transmissions involving PII are executed using secured HTTP (HTTPS) through a web-browser or secure application. Walker Edison utilizes standard security measures, such as firewalls, limited access, and SSL encryption technology to help protect against misuse and alteration of PII during transmission.


PII is controlled by both physical and logical controls. Only selected members of the Walker Edison staff can access raw PII on disk or backups. All backups stored offsite are encrypted. Our production systems are housed in a tier-1 hosting facility that is monitored 24 hours a day, 7 days a week. Access to these systems is logged and monitored.

 
Walker Edison is committed to acting quickly on credible information regarding unauthorized access to PII and will inform applicable regulatory bodies as necessary of any such discovery within required time limits. Walker Edison will notify any affected parties without undue delay where required under applicable law.

 

THIRD PARTY LINKS

Our website may contain links to other third-party websites which are not in Walker Edison’s control and which have their own privacy policies. Walker Edison is not responsible for these third-party sites. You visit them at your own risk, and we encourage you to read their privacy policies. For example, you may use a third-party payment option (such as PayPal) to pay for orders. The privacy policy and practices of that third party payment provider will apply to your PII.

 

In addition, your browser may already contain cookies placed by third-party sites, including various social media platforms. Walker Edison is not responsible for the PII such cookies may collect or what they may do with it.

COPPA AND CHILDREN’S PRIVACY
The Children’s Online Protection and Privacy Act (COPPA) generally regulates collection of PII about children under the age of 13 for marketing purposes. Because Walker Edison receives PII primarily through Partner orders, the COPPA policies of our Partners generally apply.

Our services are not directed to or intended for use by minors. If it is determined that PII has been inadvertently collected on any minors without the necessary consent, we will immediately take steps to ensure that such PII is deleted, or in the alternative, that the necessary consent is obtained for the use and storage of such PII. Any minors as defined under applicable law must seek and obtain parent or guardian permission to use this website.

YOUR RIGHTS

Depending on your location, you have certain rights regarding PII. These rights may include:

 

  • The right to know about PII collected about you;
  • The right to access your collected PII;
  • The right to have your PII deleted (though some exceptions may apply);
  • The right to have your PII rectified or corrected (if inaccurate);
  • The right to data portability;
  • The right to restrict use of your PII, including to limit use and disclosure of sensitive PII; and
  • The right to opt-out of the sale or applicable sharing of your PII.

 

Your rights may also include the right to opt out of automated decision-making and profiling and the right to non-discrimination. Walker Edison will not discriminate against you because of your exercise of your data privacy rights.

Upon receiving a data privacy rights request, and depending on which right(s) you wish to exercise, we may ask that you provide sufficient verifying information. If your request is denied or if you feel that your PII has not been handled appropriately according to applicable law(s), you may be able to appeal that decision. GDPR

The General Data Protection Regulation(s) of both the European Union and the United Kingdom (hereinafter collectively the “GDPR”) place limitations and regulations on the collection, processing, and storage of personal data (or PII, as defined herein). The foregoing sections of the Privacy Policy set out the types of PII Walker Edison processes, how Walker Edison uses PII, and the categories of third parties Walker Edison shares PII with. Walker Edison further addresses some GDPR specific issues in this section.

 

Walker Edison is generally a Processor of the PII you (the data subject) provided to a Controller, though it may on occasion act as a Controller itself. Walker Edison only processes PII received as set out within this Privacy Policy.  

Your PII is processed in Salt Lake City located in the United States of America. Hosting and storage of your PII takes place in the United States. We protect such transfer of your PII with data transfer mechanisms set out by GDPR Chapter 5. Walker Edison may share PII with third-party entities or providers in order to fulfil its legitimate data processing purposes, as set out above. Walker Edison has never been subject to a United States FISA 702 directive or any requirement to disclose PII in connection with United States Executive Order 12333.

You may have certain data privacy rights under the GDPR. These rights may include the right to be informed about what PII is collected from or about you and the details surrounding that collection. They may also include the right to access your collected PII, the right to have your PII rectified (if inaccurate or incomplete), the right to be forgotten (though some exceptions may apply), the right to restrict processing, the right to data portability, and/or the right to object to processing under certain conditions. You may also have some rights in relation to automated decision making and profiling.

To the extent Walker Edison is only acting as a Processor, your request may be sent on to the applicable partner and/or Controller. To the extent Walker Edison may be the Controller for the processing of your PII, you may also reach out to us at privacy@walkeredison.com for the contact information of our EU and/or UK representatives.

 

Upon receiving an applicable request and depending on which data privacy right(s) you wish to exercise, we may ask that you provide sufficient verifying information. If you have a complaint, our data privacy team will look into it upon receipt and will work with you to resolve the matter. If you still feel that your PII has not been handled appropriately according to applicable law, you can contact the Data Protection Authority for your country of residence and file a complaint with them.

 

CHANGES TO THIS PRIVACY POLICY                          

This Privacy Policy is effective as of March 27, 2023. Any material changes to this Privacy Policy will be communicated directly to all users through the communications channel designated for each user as stored within the existing infrastructure within which Walker Edison operates. Additionally, as changes are made to this Privacy Policy, archived links will be included to identify the various versions of the Privacy Policy according to their respective effective dates.
